Kolors Health Care to pay 1.5 lakhs to an auto driver

HYDERABAD: Kolors Health Care has been directed by the District Consumer Redressal Commission-III, Hyderabad to refund Rs 1.30 lakh (plus 12 percent interest) and Rs 5,000 for litigation costs to a Hyderabad resident for unfair trade practice and damaging his health.

Case details reveal that Perka Ram Babu, an auto-rickshaw driver from Langer House, Hyderabad, approached Kolors Health Care for weight loss treatment. He paid Rs 500 and additional charges of Rs 5,000. Kolors Health Care assured him of weight reduction and set the service rate at Rs 1.30 lakh.

Without Ram Babu’s consent, Kolors Health Care staff completed a loan process for Rs 1.30 lakh from “FIBE DO” and informed him to pay Rs 14,000 EMI every month for 12 months. Ram Babu reluctantly accepted the loan transaction and began treatment.

Despite experiencing back pain and expressing his desire to discontinue treatment, Kolors assured Ram Babu that the pain was temporary and would subside after weight loss. However, his condition worsened within a month, leading him to halt treatment after 15 sessions.

Ram Babu, financially strained with meager income, was unable to afford the Rs 14,000 monthly EMI. Despite his requests, Kolors refused to refund the amount or close the loan. In response, Ram Babu approached the Commission, citing deficiency in service by Kolors. Despite receiving notice, Kolors failed to appear or provide a written response within the stipulated period.

The Commission, noting the evidence of health damage and payment of Rs 1.30 lakh by Ram Babu, unopposed by Kolors, deemed the failure to refund the amount as both deficient service and unfair trade practice.

As a result, the Commission directed Kolors Health Care to refund Rs 1.30 lakh with 12 percent interest from October 22, 2023, until realization, along with Rs 5,000 for litigation costs to Ram Babu.
