POCSO case: Brother who impregnated his own sister sentenced to Life imprisonment

Hyderabad/ Langer house: A 19- year old brother who impregnated his 13 year old minor sister was sentenced to life imprisonment by Special court dealing with POCSO cases on Tuesday. Although the victim and her mother turned hostile during the trial, the police were able to nail the accused through DNA evidence.

According to the police the victim’s mother has 4 children, and the victim was the youngest of the four siblings and the accused was the eldest. Their father abandoned the family. The accused is a bike mechanic. The victim got abused by the accused by threatening her for more than a year in their own house in the absence of the family.

On 20th May, 2021 when the victim’s mother observed changes in the victim, she took her to a private clinic where she got to know that the victim is pregnant. Later, the victim’s mother approached Niloufer Hospital for abortion. The Niloufer doctors refused to do without the Court Order.

In a helpless condition the victim’s mother approached the Langer House police station, who registered case under Protection Of Children from Sexual Offence(POCSO) Act, 506 IPC(criminal intimidation), and 376 IPC( Punishment for rape). After thorough enquiry, police filed the charge sheet accordingly.

Hurdles of investigation team

Explaining the hurdles faced by the investigation team, police said, “It was very challenging to follow the Medical termination of pregnancy(MTP) procedure. After 3 days through thorough follow-up by Legal Counsellor, MTP was done with the court order”. Adding to the woes was pandemic, “As it was pandemic time, the Bharosa team visited their home and gave groceries, fruits and victim assistance fund(VAF) for the client as she was very weak and mal-nutrition. Further Bharosa provided shelter for more than 1 year,” said Hyderabad police in an official press statement.

During the trial the victim’s mother reportedly turned hostile, she took the custody of the victim through court order and absconded whenever police personnel served the summons.

Meanwhile the accused married a girl and convinced the victim to withdraw the case. Since then, Bharosa team along with police officials and CDOs continuously followed-up with the PP all through the prosecution evidence in this case. Doctor’s evidence and the DNA Report was very supportive in getting life conviction.

Additional Metropolitan Sessions Judge Cum Special Fast track Court, Nampally T Anitha convicted the accused and sentenced to Undergo Rigorous Imprisonment for life and to pay a fine of 5000 for offence u/s 5(l)(j)(ii)(n) r/w POCSO ACT in default further directed to undergo Simple Imprisonment for 6 months. And sentenced to undergo rigorous imprisonment for 2 years and pay fine of Rs 2000 for offence u/s 506 IPC in default Simple Imprisonment for 3 months.
