TGRERA order directs SVB Estates to refund ₹26 lakh with 10.75% interest to buyer in Bird of Paradise layout case

HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has directed the Bank of Maharashtra to stop collecting equated monthly instalments (EMIs) from two homebuyers in connection with a delayed residential project by Aliens Developers Private Limited at Tellapur.

In an interim order dated December 22, 2025, TGRERA exercised its powers under Section 36 of the Real Estate (Regulation and Development) Act, 2016, after observing that the complainants were facing continuing financial hardship while their request for cancellation and refund remained unresolved.

The complainants, Kalletla Kranthi Kiran and K. Madhuri, had booked a flat in the “Aliens Space Station” project at Tellapur village in Ramachandrapuram mandal of Sangareddy district. The project, spread over about 19 acres, was registered with RERA on November 16, 2023.

According to the complaint filed under Section 31 of the Act, the developer had initially assured possession by May 2025. The complainants said they paid ₹35,20,533.45, about 25% of the sale consideration, in September 2022 while booking Flat No. 721 in Station 4. The booking was later shifted to Flat No. 1116 in Station 3, with a revised sale consideration of ₹1,34,11,555.

They alleged that despite collecting 25% of the amount, the developer failed to execute a registered agreement for sale at that stage, in violation of Section 13(1) of the Act, and continued to demand further payments. A registered agreement was eventually executed on June 24, 2024, for a total consideration of ₹1,40,82,133, which the complainants described as unilateral and one-sided.

Following a home loan and a tripartite agreement dated June 29, 2024, another ₹35,20,533 was disbursed to the developer through the Bank of Maharashtra. The complainants told the authority they are paying EMIs of over ₹1,00,000 per month, even though construction progress at the site was minimal, with only the parking slab completed.

They further alleged that the developer unilaterally extended the project completion timeline to March 2027 with an additional grace period, prompting them to seek cancellation and refund through emails in December 2024 and February 2025. The developer, they claimed, neither processed the refund nor cited any refund conditions contained in the agreement, instead referring to a “locking period” linked to resale.

After hearing all parties on December 10, 2025, TGRERA noted that the cancellation and refund issue was still pending, while the complainants continued to service high EMIs. To protect them from further financial burden during the pendency of the case, the authority directed the Bank of Maharashtra’s Kothaguda branch not to demand, debit or collect any further EMIs related to the flat until further orders.

The matter has been posted for further hearing on January 6, 2026.
