Homebuyers Win Relief as TG RERA Directs Balaji Elegancia Builder to Complete Infrastructure

Telangana RERA Appellate Tribunal ruling on 500 square yard project exemption in Hyderabad

HYDERABAD: The Telangana Real Estate Regulatory Authority (TG RERA) has directed M/s Balaji Constructions to complete all pending infrastructure and common amenities in the Balaji Elegancia villa project at Kompally in Medchal-Malkajgiri district within 60 days. The Authority also warned the developer of penal action if it fails to meet the deadline.

Residents of the project filed Complaint No. 375/2025 through the Balaji Elegancia Villa Owners Mutually Aided Co-Operative Maintenance Society Limited. They alleged that the developer had not completed several amenities promised at the time of sale.

Homebuyers said they purchased villas based on promises made in brochures and sale agreements. These promises included a fully functional clubhouse, sewage treatment plant, water treatment plant, 100% power backup and security systems.

To verify the claims, TG RERA appointed the Engineering Staff College of India (ESCI) to inspect the project. ESCI found that many villa owners had already occupied their homes. However, the developer had not completed several common amenities and infrastructure works.

The inspection team noted that the pending works remained incomplete even after the project’s completion deadline of September 1, 2024.

Developer’s objections rejected

TG RERA used its powers under Sections 37 and 38 of the Real Estate (Regulation and Development) Act, 2016, to reject the developer’s objections. The developer had questioned the project’s extension status and the legal standing of the residents’ association.

The Authority said promoters must complete all promised amenities and common infrastructure when more than two-thirds of the units are occupied. It added that developers cannot avoid or transfer this responsibility.

Final 60-day deadline

TG RERA directed the developer to complete all pending amenities within the timelines submitted before the ESCI inspection.

For works that have already crossed the promised deadlines, the Authority granted a final 60-day period from the date of the order.

The Authority also warned that it would initiate action under Section 63 of the RERA Act if the developer fails to comply. The section provides penalties for ignoring orders issued by the regulator.

TG RERA said the order reflects its commitment to protecting homebuyers and ensuring transparency and accountability in Telangana’s real estate sector.
