Telangana RERA issues interim injunction against developer over property sale in Ameenpur
Hyderabad: The Telangana Real Estate Regulatory Authority (TSRERA) has issued an interim injunction against M/s Aspire Spaces Pvt. Ltd., preventing the developer from selling or transferring properties in their “Aspire Spaces Ameya” project in Ameenpur, Sangareddy district. following a complaint from a homebuyer.
The disputed property includes 39,031.94 yards (Schedule ‘A’ property) and 6,860 square feet (Schedule ‘B’ property) located at Ameenpur Village, Sangareddy district.
The directive follows a complaint filed by Shankar Babu under Section 31 of the Real Estate (Regulation and Development) Act, 2016. According to the complaint, Babu entered into a sale agreement with the development firm on August 21, 2023, and paid the full consideration amount of ₹3,35,72,000.
Babu alleged that the developer failed to fulfill its contractual obligations, including timely completion of the project and execution of a sale deed. He also claimed that the development firm dishonored post-dated cheques and failed to deliver the promised properties.
Concerned about the potential alienation or transfer of the properties, Babu approached TSRERA on October 28, 2024, seeking an interim injunction to protect his interests. During the hearing on November 1, 2024, the developer did not oppose the application.
After considering the arguments and evidence presented by the complainant, the regulatory authority issued interim directions restraining the development firm from creating any third-party rights, alienating, or transferring any interest in the disputed properties until the final resolution of the main complaint.
