TGRERA closes suo motu case against My Home Constructions over My Home RAKA project

HYDERABAD: The Telangana Real Estate Regulatory Authority (TGRERA) has closed suo motu proceedings against My Home Constructions Pvt. Ltd. in connection with its project My Home RAKA at Madinaguda, Ranga Reddy district, after finding no evidence of fraudulent registration or suppression of material facts.
The order, issued on October 16, 2025, follows a detailed hearing held on August 22, 2025, where the promoter was represented by B Sharath, authorised signatory of the company. The proceedings originated from petitions filed by P Rama Gopal Rao, General Power of Attorney holder for Anandjeeth Kaur, widow of Thandra Shivakumar Goud, alleging that the developer obtained RERA registration using fraudulent documents.
Petitioner alleged illegal land acquisition
Rao alleged that My Home Constructions had acquired land in Survey No. 98 of Madinaguda village from individuals who had lost ownership through earlier legal proceedings dating back to 1980. He sought revocation of the project’s registration under Section 7(1) of the Real Estate (Regulation and Development) Act, 2016, and initiation of criminal action against the builder.
The petitioner cited historical revenue and judicial orders, including those issued by the Tahsildar, Rajendranagar (1980), Joint Collector, Ranga Reddy district (1980), and the High Court (1981), as well as pending civil suits O.S. No. 123/2021 and O.S. No. 71/2023.
Builder denied allegations of suppression
In its defence, My Home Constructions stated that it had lawfully purchased the land through registered sale deeds and had disclosed all required details while obtaining registration on December 20, 2021. The company argued that the civil suits were filed much later, and it had no knowledge of them when seeking registration.
The builder also submitted that the Greater Hyderabad Municipal Corporation (GHMC) had rejected a similar complaint by the petitioner in October 2022, and the Telangana High Court later dismissed related writ petitions and review pleas.
Authority’s findings
After examining submissions, the Authority found that:
The project was registered on December 20, 2021, and valid until November 9, 2025.
The suits cited by the petitioner were either internal family disputes among claimants or filed after registration.
There was no proof that My Home Constructions was aware of any pending litigation when it sought registration.
“The petitioner has not produced any evidence to show that notices in O.S. No. 123/2021 or O.S. No. 71/2023 were served on the promoter prior to registration. Hence, deliberate suppression cannot be established,” the order stated.
Registration to remain valid; developer cautioned
Holding that no violations under Section 7 of the Act were proved, TGRERA ruled that revocation was not warranted. However, it directed My Home Constructions to:
Update project details on the TG RERA portal, including references to the pending civil suits.
Ensure that Quarterly Progress Reports (QPRs) are filed on time.
Indemnify and safeguard allottees if any adverse court orders arise in future.
“The promoter is cautioned that any adverse outcome in ongoing litigations affecting the project land shall attract liability under the RE(R&D) Act, 2016,” the order concluded.
