Telangana HC imposes ₹3 lakh penalty for unauthorised building in Hyderabad
HYDERABAD: The Telangana High Court has imposed a ₹3 lakh penalty on a Hyderabad property owner for carrying out unauthorised construction beyond the sanctioned building plan while directing municipal authorities to consider the owner’s application for regularisation.
Justice Bollam Vijaysen Reddy passed the order while hearing a petition filed by Aruna Agarwal, a resident of Alkapur Township in Neknampur village, Gandipet.
Court flags growing problem of illegal constructions
According to the case, the sanctioned building plan permitted a ground floor and two upper floors. However, the petitioner allegedly constructed two additional floors and a penthouse, despite directions from municipal authorities to stop the work and remove the unauthorised portions.
The court observed that the illegal construction created nearly 8,000 to 10,000 sq ft of additional built-up area.
During the hearing, the petitioner’s counsel submitted that the extra space had been built to accommodate a joint family. The petitioner also sought a direction to the municipal authorities to consider an application for regularisation.
Justice Reddy observed that unauthorised constructions had become a major concern in Hyderabad and stressed the need to address the issue.
Penalty earmarked for sanitation workers and young lawyers
While directing the municipal authorities to consider the regularisation application, the court imposed a ₹3 lakh penalty on the petitioner.
Under the order, ₹2 lakh will be paid to the municipal authorities for the welfare and health benefits of contract sanitary workers and scavengers. The remaining ₹1 lakh will be paid to the Telangana High Court Advocates Association for the welfare of young lawyers.
