Telangana High Court pulls up HYDRAA Commissioner in contempt case over land

HYDERABAD: A Division Bench of the Telangana High Court found the Hyderabad Disaster Management and Asset Protection Agency (HYDRAA) Commissioner guilty of contempt. The case relates to disputed land in Bagh Amberpet.

The Bench of Justice Moushumi Bhattacharya and Justice B R Madhusudhan Rao said HYDRAA showed “flagrant disregard” for its June 12, 2025 order. The court had allowed only limited pre-monsoon work. It had also directed officials not to affect the petitioner’s rights.

Land changed beyond permitted limits

Photos submitted to the court showed major changes to the land. Authorities developed it into a recreational space called “Bathukamma Kunta”.

The Bench said these changes went far beyond what it had allowed. The work altered the land’s nature beyond recognition. This happened while the case was still pending.

The court held that these actions amounted to wilful disobedience. It also said they interfered with the justice process.

Court rejects ‘no prejudice’ claim

The court rejected the respondent’s claim that no harm was caused since the land was not given to third parties.

It said changing the land itself harms the litigant’s rights.

The Bench also warned that no party can “enjoy the fruits of contempt”.

Court orders removal of structures

The court directed the Commissioner to remove all structures within four weeks. This includes gates, boards, signages, and any markers showing control over the land.

The respondent must also submit a compliance affidavit.
