Supreme Court strikes down HC order on Rs.8000 crore Raidurg land

HYDERABAD: The Supreme Court has overturned a Telangana High Court decision on 85-acre land parcel in Raidurg. Valued at approximately Rs 8,000 crore, this land faced claims from various parties, including film producer Burugupalli Sivarama Krishna and a major infrastructure company.
A Supreme Court bench, led by Justice Sanjiv Khanna and Justice Dipankar Datta, in its judgement on July 22nd noted, “… Division Bench (review) erroneously held the State to have practiced the fraud; and this discussion is necessitated since, to the contrary, there seems to be sufficiently reasons to hold the first respondent responsible thereof.”
Supreme Court further added “for the foregoing reasons, we conclude the High Court exceeds both its review and contempt jurisdiction. The impugned order is, thus, set aside, and the judgement and order of the Division Bench (original) in the contempt appeal and letters patent appeal is restored”.
Supreme Court Judgement further stated, “Determination of the title to the subject land, adjudication on the validity of the decrees in favour of the respondents, or decision on the land issue are left open for a forum of competent jurisdiction to embark upon, if approached by any of the parties. None of the observations of this Court, or of the High Court in the impugned order should be treated as an expression of opinion in any particular matter or on any factual aspect whatsoever”. The petition in supreme court was filed by one M. Lingamaiah against S. Tirupathi Rao, Tahsildar, Serilingampally.
