Supreme Court defers Dasoju Sravan MLC case to March 19
TELANGANA: The Supreme Court of India on Monday deferred the hearing on a petition filed by Dasoju Sravan challenging the appointment of members of the Legislative Council (MLCs) under the Governor’s quota, to March 19.
Constitutional issues flagged by bench
A Bench comprising Justice Vikram Nath and Justice Sandeep Mehta said the case involved significant constitutional questions and that detailed arguments from all parties were required before a decision could be taken.
The court, therefore, fixed March 19 as the next date of hearing.
Focus on Governor’s powers
Legal circles said the case could lead to important directions on the scope of the Governor’s powers in nominating MLCs, including issues of political intervention, limits of discretion and transparency in appointments under the Governor’s quota.
Observers believe the next hearing on March 19 could bring greater clarity on these constitutional aspects.
The Bench also indicated that the Attorney General should be available on the next date of hearing.
