DoT advisory warning users about SIM misuse and tampered IMEI numbers

HYDERABAD: Mobile subscribers may be held liable if SIM cards taken in their name are later misused for cyber fraud or other illegal activity, the Department of Telecom said on Monday.

In an advisory, the department urged citizens not to use mobile phones with tampered International Mobile Equipment Identity (IMEI) numbers. It also cautioned users against buying or using procured or assembled devices such as modems, modules and SIM boxes with configurable or altered IMEIs.

The advisory warned citizens not to obtain SIM cards through fake documents, fraud or impersonation, and not to hand over SIM cards issued in their name to others, as they may be misused.

Legal liability for original subscriber

“Citizens should be aware that using devices with tampered IMEI numbers, procuring SIM cards through fraudulent means, or transferring or giving their SIM cards to others who misuse them for cyber fraud can result in serious legal consequences. The original user may also be held liable as an offender in cases where SIM cards procured in their name are subsequently misused,” the statement said.

Stringent penalties under new telecom law

The department advised subscribers not to use applications or websites that modify the Calling Line Identity or other telecom identifiers.

The Telecommunications Act, 2023 provides for penalties including imprisonment up to three years, fines up to ₹50 lakh, or both, for tampering with telecom identifiers such as IMEI numbers. The Telecommunications (Telecom Cyber Security) Rules, 2024 bar any person from altering an IMEI or possessing equipment capable of doing so.

Sanchar Saathi recommended for verification

The DoT urged citizens to verify IMEI details through the Sanchar Saathi portal or mobile app, which displays device brand, model and manufacturer information.

“The government has implemented the Sanchar Saathi initiative to help citizens verify and secure their mobile connections. Strict checks are in place to prevent misuse of telecom resources and ensure a secure telecommunications ecosystem,” the statement added.
