BRS leader Kavita steps out of Tihar jail, reunites with family in an emotional moment

Hyderabad: An emotional moment unfolded, as Kalvakuntla Kavitha steps out of the Tihar jail on Tuesday, after spending nearly five months over there in the custody.After the release, Kavitha met her family members and party workers outside the jail complex, including, his brother K Taraka Rama Rao, the working president of Bharat Rashtra Samithi (BRS) and her husband Anil Kumar and son. BRS leader, Harish Rao along with other BRS leaders are also present welcoming Kavitha.
It is pertinent to note that the Supreme Court on Tuesday granted bail to the Bharat Rashtra Samithi (BRS) leader Kalvakuntla Kavitha in connection with the Delhi excise policy scam, which is being investigated by the Enforcement Directorate (ED) and the Central Bureau of Investigation (CBI).
After coming out of Jail, Kavitha said, “I am stubborn. This illegal arrest only makes me more stubborn. I will fight back and pay back with interest says an emotional Kavitha Kalvakuntla after stepping out of Tihar.”
Reports add, prior to the release of Kavitha from the Tihar jail, she had to undergo medical tests following which she would be released. Kavitha’s passports would also be submitted to the concerned authorities, making sure that she does not leave the country.
The Delhi Liquor Scam’s case is still ongoing, as of now, Kavitha is out only on a bail.
The Apex Court and the bail saga
The decision of her bail came after the Apex Court found that the lower court had misapplied legal provisions in denying her bail. The decision was delivered by a bench comprising Justices B.R. Gavai and K.V. Viswanathan.
Senior Advocate Mukul Rohatgi, representing Kavitha, argued that with 493 witnesses, 50,000 pages of documents, and 57 accused in both the ED and CBI cases, there is no risk of her fleeing, as she is a sitting MLC and sought bail in both the ED and CBI cases in the matter. Additional Solicitor General (ASG) Raju arguing for the CBI and ED, opposed her bail application and countered that beneficial provisions should not apply to Kavitha.
The Apex court observed that the “investigation is complete and a chargesheet has been filed. Custody of the appellant is not necessary. She has been behind bars for 5 months. The likelihood of a trial being concluded in the near future is impossible”.
