₹6 crore Aston Martin seized in Madhapur fatal crash probe

HYDERABAD: Police investigating the August 16 road accident in Madhapur that killed a mall employee have seized the Aston Martin involved in the crash and sent it to a motor vehicle inspector (MVI) for examination, as reported by TOI.
Kukatpally DCP Ritiraj said police were awaiting the MVI report, which would form an important part of the investigation. The Aston Martin, valued at around ₹6 crore, is registered in the name of Honer Prime Housing.
Police registered Crime No. 1238/2026 at Madhapur police station under Section 106(1) of the Bharatiya Nyaya Sanhita (BNS).
Driver tested for alcohol and drugs
Police said they apprehended the driver after registering the case and conducted preliminary alcohol and drug tests. Both tests returned negative.
Investigators later collected his blood samples and sent them to the Forensic Science Laboratory for detailed examination.
Police said they invoked Section 106(1) of the BNS based on the facts and circumstances available at the time. The section carries a maximum punishment of five years in prison.
Police explain why no arrest was made
Police defended their decision not to arrest the accused, saying the investigating officer must first assess whether an arrest is necessary in offences carrying a punishment of less than seven years.
Ritiraj said the decision followed Section 35 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) and the Supreme Court’s guidelines in Arnesh Kumar vs State of Bihar.
“On an objective assessment of the material then available, no circumstances warranting the arrest of the accused were found to exist,” Ritiraj said.
Police also rejected claims that the accused escaped arrest because of political or other influence. They said officers based the decision only on the legal provisions governing arrests and the evidence available at that stage.
Police said they would take further action based on evidence that emerges during the investigation.
